484.28 | help with ticket | VLNVAX::BROCKELMAN | the brock | Wed May 28 1997 10:06 | 12 |
| I have a question regarding a speeding ticket. My son got
pulled over last week by a cop traveling in the opposite
direction. Immediatly after the cop goes by my son he spins
around and follows him for about a mile then pulls him over
saying he clocked him at 51 in a 30 mile zone. Son says
he was doing about 40. I sent in the ticket for a hearing.
Were not looking to get it dropped, just reduced. My question
is, if they do find him for doing 51 is the ticket ($160.00)
due then and there?
thanks in advance.

| Go to court and ask the cop how he determined that he has made this
discovery. As in, if the cop says he tagged your son going in the op
direction from a moving cruzer, then you got a case. For, there is
error in the speedo on the cops car, and the cop should have been at a
sitting position to make an accurate reading of the actual speed of
your son. In short, the real speed was not properly read cause both
cars were in motion.

| re.28
The cruiser may have had the approach radar setup which can determine
the speed of an oncoming vehicle by automatically adjusting for the
cruisers "closing speed". From personal experience I know Lancaster has it.
Nice cop though and he left me off with a warning.

| You will not have to pay at the clerk-magistrate hearing. If found
responsible, the magistrate will ask if you intend to pay today.
If not, they will usually give you some amount of time that you
negotiate with them. They would probably request full payment
within 4 weeks though.

484.33 | Radar automatically compensates | TUXEDO::BAKER | | Thu May 29 1997 11:47 | 8 |
| Re .29
The radars do not rely on the speedometer readings. Radars that are
capable of detecting cars going in the opposite direction determine
the speed of the cruiser independently of the car's speedometer. The
defense would be "did you use a radar that compensates for the cruiser's
speed?" (very unlikely that they did not) and then "when was it last
calibrated?".

Yup. Two beams are fired. One is the reference speed beam (shot at the
road surface) and the other is the detector beam (fired at the moving
vehicle)
they work coming and going, too. He can bag you as he is pulling away from
you (after you've passed him)
