I think this is relevant to this notesfile. ......
Following on is an essay topic from my son's Law course.(1styear, 4th
Essay). Since it involves some pretty good concepts and words, we felt
it should cause some erudite discussion. If it does, he will try and
get it marked ..
so for all the 'tween-deck lawyers.......
Evaluate the nature of the corruption of the American republican
form of government. To what extent can it be said that language
was implicated in the distribution of authority and retreat from
politics? Can it be argued that the capacity for liberal economic
theory and the new market economy to utilize the conceptual apparatus
of the common law tradition, whose language embodied the values
of "homo economicus" and the private sphere, rather than the ideals
of a republican form of government, resulted in the subsumption
of politics under economics?
