| I believe what your landlord is doing is illegal. He can't just decide
something without legalizing it first. If your lease doesn't specify
no cats then you should still be entitled to keep them unless he draws
up a new lease and you sign it accordingly.
I hope the outdoor cats are fixed. This will ensure that the cats
don't multiply and further aggrevate your landlord.

| Is there some kind of legal limit re: the number of cats a household
can have before it becomes a business? Maybe that is what the landlord
is concerned about.

| Most California cities and counties have ordinances that limit the
number of pets that any given household can have living with it. Our
town limits the number of pets to two.
My feeling is that the landlord in this case was more concerned about
his property than about city or county ordinances.
Also, the number of animals isn't what constitutes a business. Whether
or not any profit was being made would be the deciding factor.

animals???????!!!!! Oh Gosh, I could never live there! What is
their reasoning? No wonder there is so many homeless animals...
the people that want to have more can't. How sad for everyone
involved.

in San Jose, the ordinance is seldom enforced IF, and only IF, the animals
are not a nuisance to the neighborhood. Cats that are allowed to roam
free are considered a nuisance and if a complaint is filed, the owner
can be limited back down to 2 cats/dogs (at least in my neighborhood
this is the case, but we do have an endangered species of bird nesting in our
area and that may make a difference). Of course, there is also a leash law...
and that is also enforced for cats if the cats become a nuisance. If the
cats are indoor-only, and the house is not a rental, then noone ever raises
the issue....I should know, we live with 3 cats and a dog right now...and
I'm going to pick up my new "baby" any day now....I'll post an introduction
as soon as she is settled in.
BTW, I don't know any animal lover who has only 2 animals....usually the
number runs around 2 -4 cats and then a dog or two. The reason there are
so many homeless animals is because people do not limit the birth rate of
their pets. They continue to believe that "one litter won't hurt"....
multiply that attitude by the hundreds of thousands of residents of
Silicon Valley who are pet owners....it doesn't take a genius at math to
figure out where the unwanted pet animals come from.

| Re. .7 well, actually I do know animal lovers who have only one animal-
sometimes that is all they can afford - and sometimes it is a stretch
of funds even for that one critter.
But I think we are getting away from the base note - there is a little
kitten who needs a home. Hopefully he will soon find a home.

Up in S.F. I understand that you have to get a permit for over 4 cats -
but I believe you are allowed up to 4 - but I've never heard or known
of anyone getting a permit.
My landlady got upset when we added our third cat and since she's
enforced a "no Pets" to incomming renters - however - even thought she
did put up a fuss and hinted that one had to go - she never told us to
get rid of him(them). Her son-in-law is in real-estate and I'm sure
has filled her in on the laws as she never put a limit on the # of
animals we could have when we moved in.

| Has anyone responded to Sue Ellen? I'm wondering if Half Pint has found
a new home yet? I'll have to ask Sue Ellen when I see her, if anything
has changed w/ the land lord. I can't believe him either, but who would
WANT to fight this jerk & continue living under HIS roof?! Certainly
not ME! He could make her life a living hell if he wanted to, and with
perfectly legal circumstances, I might add!
I really hope 1/2 pint finds a home. She's a little DOLL! I almost took
her when she was 6 weeks, but she was found a home (which ended up
not working out because the people coulnd't keep her) by the time I
came to look at her. I ended up taking Callie, her sister, who turned
out to be a MOOSE! I LOVE CALLIE, but feel bad now, because if I had
taken half pint, this problem wouldn't have happened! :*(
Any word?

| I send some mail concerning the tenants rights in this situation but
have received NO reply. Perhaps Sue isn't interested in hearing from
anyone but someone interested in half-pint. Sometimes when folks
have considered all the options and made the painful decision to
place the cat they would rather not explain the situation to others.
If anyone has any news on this situation please post it. I have also
been thinking about half-pint. Wish my house wasn't quite so full
at the moment.
