66.0. "Sexually Transmitted Diseases" by TROOA::COLLINS (Not Phil, not Tom, not Joan...) Fri Nov 18 1994 14:38

Three Ontario women who contracted HIV from a man who was deliberately
spreading the disease have applied to the Criminal Injuries Compensation
Board for money to ease their situation. The maximum possible award is
$25,000.00, but the board awarded them only $15k, arguing that the
women themselves must bear some responsibility for their infection.
Their relationships with the man were generally brief, and they did
not use condoms during some or all of the sexual encounters.

Does the fact that this man (who has since died of AIDS) was deliberately
spreading the disease make these women victims of a crime, or are they
simply careless individuals who should have known better? Are they
entitled to redress above and beyond the universal health care available
    to all Ontario residents?

    yes, yes and no.

If the women are due anything, it is from the criminal (or
his estate) and not from the government.

I believe the man was criminal in his intent and actions.

Did this man know that he was infected with the AIDS while he was
    having sex with this women?

Yes, he did, and was tried for it. He died during the trial, so no
verdict was ever returned. However, his lawyer argued that he was
sufferring from a form of denial, and believed that he did not have
AIDS, even though the Middlesex County Board of Health had taken out
a court injunction against him prohibiting him from having sex with
    anyone.

Kind of hard to enforce, no? Do they have Middle Sex Police?

    .6:

Yes...in fact, impossible to enforce. By the way, my previous note
may be read to indicate that the man was tried for having AIDS. In
fact...he was tried for infecting the women. Not sure what the exact
    charge was.

It was right to bring the guy to trial for knowingly having AIDS, and
going out and infecting the women on purpose. It was right to say the women did
have a part in all this by not making sure condoms were in place, and not
making sure of the person's status. But I guess if it's a one night stand, or
just a couple of rolls in the hay, then no one would bother to say, "Hey, let's
wait before we do this. I want us both to be tested."

Hmm... it's much clearer why our departed Mailroom was so
fond of his other job.

After all that stuff in the welfare topic, and look at what I
    	found.

This would have been a better place for that "women should be
responsible for what they let into their bodies" discussion.

Shawn, considering that the only way to prevent sexually transmitted
diseases during sex is to use condoms (male birth control devices),
your argument wouldn't have had a leg to stand on here, either. :/

If you think about it, to prevent any disease, it doesn't take a 50/50
decision. No matter what anyone says, it doesn't take 2 responsible people.
Only 1 is needed. If a disease is caught, then the blame is 50/50.

I would clarify this statement to say..

I was reading in the Daily Telegraph yesterday that the Peter Pan of
Pop,Sir Cliff Richard, abstains from sex. He says it`s too messy, and
complicates his life too much. The article went on to say that a large
minority, perhaps even majority, are neither obssessed with sex or
particularly bothered if they have sex or not. Contrary to what the
    popular press say.

Still, this is the UK we`re talking about.

Maybe he abstains from sex because he's too old and ugly to
    	get any.

Back in his musical prime, he was probably blowing another
    	horn, so to speak.

Strange that I should find this topic, because I just got Tony
Carey's "Cold War Kids" on CD the other day and was listening
    	to it in the car.

He's got a song called "Don't Cover It Up", in which he basic-
ally says "it's the woman's responsibility to ensure that
birth control is used, not the man's".

OK, that's as close to an April Fool's joke as I'm going to
get. The song is actually about the Pope's stance on birth
control [IE, none should be used ... and don't do it if you
    	aren't ready for the responsibility].

As president and founder of the Walker Involuntary Celibacy
Association, I can tell you that there is only one way to avoid STD's.
But the solution is a much worse alternative than any sexually
    transmitted disease you could imagine.

I hate to clue you in on this...but some of them STD's can kill you.
