The employee suit against IBM I've heard of was over the issue that
the first "package" was less attractive than later offerings.
Employees were encouraged to take the first package with assurances
that later packages would be a lesser value. Sure enough the later
package was of greater value and those employees who went for the
first round felt betrayed. Haven't heard of a resolution to the case.
