Hi.  I am being put through the DEC disciplinary mill for allegedly
harrassing another employee.    

My defense (apart from making it known there was provocation)
will be that the "incidents" took place off DEC
property, outside DEC time, so are not an issue for DEC to resolve.

Is this defense valid?  Please mail me thru the moderators ASAP (today!)
if you dont want to reply here.    Anybody know any precedents?

    (1) IMMEDIATELY GET A LAWYER but until you do...
    
    (2) Refuse to participate in any way whatsoever with any action by
    "official Digital", no phone calls, meetings, etc. pending legal
    advice.

    Policy leaves it wide open for interpretation.
    Harrassment is seen as work related no matter where it happens.
    If you are being fired get a lawyer.
    If all parties are being counselled to improve
    personal communication skills, valuing differences
    have it placed in your goal set for your next review
    work towards this improvement.
    
    Some good comes from all experiences.

It seems you've been put on the defensive.  If something between you and the
other party has so affected this other person that s/he's having trouble
functioning properly at work, then indeed, DIGITAL should be concerned.

On the other hand, since YOU'RE now on somebody's sh*t squared list because
of something that happend off DEC time/property/etc then you MUST get a
lawyer and get on the OFFENSIVE.  YOU are now being harrassed and have
DEFINITELY suffered a career-impacting episode and maybe financial hardship.

Haven't been there and don't want to be.
