You may be able to get a sympathetic personnel or EPA person to
at least call him for you. Or you may be able to convince his
supervisor or co-worker to call him for you.
This person needs to be "spoken to" and the more people that know about
it, the sooner he may be stopped.

sigh...
A model agrees to pose for a photographer and grants the rights to the
photographs in return for what the lawyers call "valuable
consideration" - in this case the negs etc.
There is a contract and the photographer is in breach of that contrat.

(PS: I am a professional photographer - if you are interested I'll
post, either here or via mail, a typical professional model release
form)

| I don't think a contract was mentioned but (and this is according to
the law in Holland), if there's no contract the photographer can't use
the photos for publication or give copies of them to others.

549.6 | | AIAG::WRIGHT | Anarchy - a system that works for everyone.... | Mon Nov 26 1990 13:22 | 20 |
| Since the basenote is gone, this is based on the replies:
In the US, in order for one individual to use a likeness (ie a photograph) of
another individual for personal gain, that individual needs one of two things -
either a contract, or a contract waiver, either of which must be signed by the
Model.
This is true for just about anything a profesional photographer would do, from
front page news pics, to publicity shots for a non-profit orginization.
If the person refered to in .0 did not sign a contract or a waiver get a
good lawyer and sue the photographer...
grins,
clark.
(BTW, I was/am a member of a theatre company for several years, everytime they
did a publicity shoot, or the local tv stations/papers should up, we had to
sign waivers...)

549.7 | pseudo-happy ending | TLE::D_CARROLL | Hakuna Matata | Mon Nov 26 1990 14:26 | 8 |
| After a few threatening (legal and or personnel action) and cajoling
letters, and numerous phone calls to his office and home, I finally got
him to hand over the pictures...
All's well that ends well, but in the future I will be more careful.
Thanks all,
D!
