674.1 | How about a form letter to insert as a reply? | PARITY::SMITH | Penny Smith, TWO/B5, 247-2203 | Tue Jan 26 1988 16:37 | 11 |
| re .0
You might consider creating a *form* letter and posting it in here, more
to encourage folks to do the mailing! (greater chance at having bigger
success than if left to each person's own creation/procrastination, etc.
efforts)
I personally would feel better about using a form letter (or modifying a
form letter) than I would about starting my own from scratch on this issue.

| I've been meaning to bring this up here.
There is a topic being discussed on Usenet about laws involving
treatment of children.
Is anyone aware that Indiana has a law against HUGGING anyone between
the ages of 12 & 16? That means that if you take your child to
a sporting event, and he/she does well, you can't hug the child
to say "Good job. I'm proud of you." without those in authority
(teachers, administrators) legally having to report you to the child
abuse authorities? We are not talking about anything remotely sexual
here - just ordinary parental loving of children.
California has a similar law. Apparently someone has been charged
with hugging his 3 year old stepchild. The judge ruled that that
was not rape (since when is hugging *anyone* rape?). There are
those trying to get the judge thrown off the bench for her decision
in this case.
I am as much for laws protecting children from abuse as anyone -
especially as a former abused child. But these type of laws are
taking it 5 steps too far.

| Hmmm...
Elizabeth, are you sure that the person on trial was clothed at
the time of hugging the 3-year-old stepchild? Seems like there
must be something more to this.

No. The family are nudists. Still, there is no claim by anyone
(including the child) that the child has been molested.
The point here is that he is *not* being charged with child molesting.
He is being charged with *hugging* her. This type of law could be used
against any unpopular group, be that nudist, gay, black, or Methodist,
to take their children away.

| Are you aware of the legal definition of Assault and Battery? Assault
means that you made someone "afraid" that you would hurt them and
Battery means that you "touched someone without their permission".
That is how the laws have always read and it doesn't just apply
to children either.

| Re .6
Does that mean that I need to get permission from a newborn baby
in order to change his/her diaper?
Do I need to get permission from a 2 year-old to put a coat on them
before taking them out in 0 degree weather?
Can a doctor be taken to court for giving an unwanted (by the child)
vaccination shot?
I somehow don't think the laws quite apply the same to young children,
although it would probably be criminal to do anything to a child
without the parent's permission (unless clearly necissary to the
child's survival).

"That the persecution and possible prosecution of the individuals that tried so
desperately to protect the children be stopped immediately."
If the other steps to safeguard the children were/are available, it is not
necessary for a parent to "kidnap" the children. I would not support parents
hiding children from their spouses under any circumstances.
RE: .2
I feel that is rediculous... (no hugging allowed)
RE: .6
That is correct about "Assault & Battery", yet sometimes, for a wide variety of
reasons it is difficult to get anything to result from a complaint of assault
and battery.

It's not always that simple to know what to do in the case of suspected
child abuse. There has been quite a fuss recently about two
Paediatricians who had used contraversial technniques to diagnose
sexual abuse in chhildren. I cant remember the number of kids that
had been taken from their parents into care, but it was considerably
more than usual for an area. Many of them were later returned to
their parents. Can you imagine what it must be like to be wrongfully
accused of molesting your child ? It must be awful. In one case
I remember hearing that the mother woyuld not let the father near
the children as she believed him guilty. What if he wasn;t ? Yes
I think it is important to regard this subject seriously, but this
seemed to be a real witch hunt. The matter was brought to light
by the press and has been reviewde (no conclusions drawn yet ) and
the two paediatricians involved moved on to other duties.

674.11 | Law to save or not save a child | DIXIE1::HILLIARD | MS ENVIRONMENT | Thu Feb 04 1988 09:48 | 31 |
| Yes we must be carefull that laws are not passed to prevint parents
from being loving parents. But do to a fear of to much law we can
not stand by in casses that are real and hapening today and say
lets not do anything. Instead the people of the United States need
to take responsability for the creation of laws and pertisapate
in the formation of laws to insure the proper type of law be introduced
and passed. This isn't what might happen to a child this is what
is happening to a child. I am not a parent, my father is a wonderfull
man and I know what happens if some one is faulsly accused of a
crime such as this, but what happens to the child when it is true
and the legal system fails her or him and the are placed in the
custody of the verry person that is abuseing them. In reality only
2% of the people accused are not guilty, so are some of you saying
inorder to save the hardship or emberasment of that two percent
lets not stop the 98% who are guilty.
I am the worlds worst speller and hope you will all over look my
spelling and read what is wrighten with the inten of the wrighting
and not the gramer or spelling. If any of you have an opertunity
to write a letter or call please do. The people in charge of the
fate of these children are electted aficials and your opinons do
influence there disisions. Let your officals know that you will
not stand for child sexaul abuse in your comunity. If you see a
child that you think there is a problem risk a little embaresment
and find out what is going on. It may save a childs life or save
that child a great deal of pain and suffering.
I am a Product Support Eng. for the Southern Area and cover nine
states I am on the road all week and home on the weekends. It is
often hard for me to read this note or any other. I will keep in
touch though and let you know the out come of these two cases.

of abusing them. If you can write a letter please do. This problem
will not go away.
