A newspaper said the alleged victim was a female friend of the suspect. Judge Birgitta Agren said the Orebro district court in central Sweden on Tuesday granted permission to keep the suspect in custody. The judge would not identify the suspect or comment further on the case. It was believed to be the first arrest in Sweden of a woman in a rape case. Sweden's penal code provides for all eventualities in rape cases, including the prosecution of a woman charged with raping a man and a woman raping another woman. The minimum penalty for rape is two years in prison. The Stockholm newspaper Aftonbladet reported without attribution that the alleged victim in the Orebro case was a female friend of the suspect. The newspaper said the suspect and a 41-year-old man allegedly forced themselves on the victim in the man's apartment. The man also is under arrest. The female suspect denied all charge, her lawyer, Lars-Olof Rosengren, told the newspaper. "She is terribly upset," he was quoted as saying.

I think, but don't remember exactly, that it's non-consentual sex. There are two laws, one with severe penalties and one with somewhat less penalties. The latter is intended to cover some cases of "date rape" when the court feels that the non-consenting partner offered conflicting signals. (I suppose there is a parallel with "first degree murder" vs. manslaughter.) Please note that I may be misinterpreting this and haven't had the need to research it. If someone wants to pursue this further, I'd recommend their first obtaining a copy of the Swedish law (call the General Consulate). I could help with any translation. By American standards, the incidence of rape in Sweden is very low and women don't seem to feel afraid to go out alone at night. Martin. |
