968.0. ""New" MASS Law Changes by F&G......." by SALEM::PAPPALARDO () Tue Jun 04 1991 18:04

    The other day I was reading both Sports Afield and Outdoor Life (June
    issues) when I came across in the listing of articles on changes
    happening in certain states. Some "NEW" laws that have been passed in
    Massachusetts are;

       1.) With current popularity in the use of decoy's for Deer, the
           State has decided it is ILLEGAL to use them during the hunting
           season due to the risk of a hunter being shot walking through
           the woods to set it up.

       2.) The use of all artificial calls (except Electronic) such as
           Grunt tubes,Bleat,and Antlers for Rattling are now LEGAL in
           the taking of deer.

       3.) The use of "Minnie" or "Maxie" balls are LEGAL during the
           Primitive Hunting season.

       4.) Baiting of deer is Legal for deer up until 10 days before the
           Archery season starts. It is ILLEGAL to use a Salt Lick as an
           attractent.

                                                        Guy

    regarding the use of artificial calls... I was talking with 2 police
    officers last week who i hunt with. Neither one of them knew it was
    illegal to use rattling antlers... It's not in the abstracts, i just
    looked. You think they made it "legal" just to have something in
    writing about what is and is not ok to use????

    Soooo, basically I guess i'm a law breaker for rattling in that deer 2
    years ago... ;^)

    What if you used _real_ antlers, as opposed to the plastic ones?

    "No your Honor, these are not an artificial call."
968.4just following up...KNGBUD::LAFOSSEMon Sep 09 1991 15:056
    well, I dug out my abstracts for the last 4 years, and came across
    nothing that said; artificial calls and scents prohibited... If they
    were in the general laws, you'd think they would put them into the
    abstracts due to their widespread use... did i miss it somewhere???

    Fra,
        I think that somewhere in the abstracts it states that not all
    the laws concerning hunting/fishing/trapping are included in the
    abstracts. A couple years ago I had a question as to whether or not
    baiting for deer was legal, it did'nt say in the abstracts so I called
    the F&G Dept and was told it wasn't.

968.6Where do you load up?TOOK::MCCARTHYGive every man his dewWed Oct 13 1993 09:2212
    Have you read your abstracts carefully this year? The normal line of
    no hunting within 500' of road or building is there, but they have
    expanded that to "NO LOADED FIREARM WITHIN 500' OF ROAD OR OCCUPIED
    BUILDING". A couple of people got fined last year on that point when
    they got out of their car, loaded up their muzzle loaders and proceeded
    up a power line. After walking in about 50 yd's, they were met by a
    Warden who asked if their firearms were loaded. They all got fines.

    I guess they are just trying to remove the question of what is hunting?
    If you load the gun and are dressed to hunt, are you hunting? Seems
    like they are saying yes you are. Seems reasonable to me. Is there
    any problem with this in terms of muzzle loaders?

968.8When is a muzzle loader "unloaded"?TOOK::MCCARTHYGive every man his dewFri Oct 15 1993 10:094
    MY understanding of the law is that a muzzle loader is unloaded if the
    cap or priming powder is removed.

968.9Please clarify the 500' rule19280::MONDOUFri Oct 15 1993 17:099
    re .6 Would you please tell me where this new regulation is
            listed in the 1993 abstract ? I could not find it.

            Under the heading " PROHIBITED", my abstract still states
            Discharge of any firearm or release of, etc, within
            150 feet of any such highway, etc.

            The only reference to 500 feet I can find is "within
            500 feet of any dwelling or building in use."
968.10WHEN::BINGOf, By, For the People? Not anymore.Mon Oct 18 1993 09:545

    I thought the abstracts also used to say "..Within 150 feet of
    a paved road.." I'll check when i go home tonight.

968.11It's in there.28214::GIFFORDA pair of 45's beats 4 AcesWed Oct 27 1993 06:4119
    Here is the exact wording out of the 1993 abstract.

    Quote,

    Discharge of any Firearm or release of any arrow upon or across any
    state or hard-surfaced highway, or within 150 feet of any such highway,
    or POSSESSION OF A LOADED FIREARM, discharge of a firearm or hunting on
    the land of another within 500 feet of any dwelling or building in use,
    except as authorized by the owner or occupant therof.

    End quote
    The emphasis on possession is mine.

    So it looks like you can load up when you get out of your truck/car but
    if you walk within 500 feet of someones house or barn that is occupied,
    while hunting, you had better unload until you're past 500 ft.

Does this mean paved road? I'm sure that whoever decided on this wording
had something concrete in mind, but it looks like it's subject to
interpretation.

	If you want to be fully compliant,and avoid
	any unnecessary aggravation...note that the
	1994 Mass abstracts now require:

	   "Stamp must be signed across face in ink
	    and attached to rear of license".

968.14steel shot only for Oxbow WMAORION::MARSHALLChanges overtook the Riders too...Wed Oct 11 1995 10:0010
    Folks,

    This year, you must use only steel shot if you hunt the Oxbow WMA near
    Littleton/Harvard, MA. This is a change the director of the WMA made
    and it didn't get much publicity. This is according to my gun club
    Legislative Rep. who works closely with the Game Wardens. Apparently,
    the director of the WMA is a stickler for rules so our Rep. asked us to
    publicize this change.
