A friend of mine has a 24' Bayliner insured through BOAT U.S.
The policy has been in force for 2 years. This summer he
developed a leak in the fuel tank. We took a look at it
and repaired it. When he first noticed the problem he
contacted BOAT U.S. to see if the insurance would cover
the repair. They sent out a surveyor and began a claims
process. We decided to just go ahead and repair it. The
surveyor indicated that if BOAT U.S. covered the repair
they would reimburse him for the parts and time at an
unskilled labor rate. This all sounded good and they
began the process of making a determination.
Now here comes the good part. After several weeks they
finally got back to him and said that they would not
cover the claim because you see technically he was never
insured with them. It turns out that when his wife
filled out the application there was a question about
previous claims yes or no. She thought the question referred
to previous claims with BOAT U.S. and checked it no. OVER
2 years ago. When he made his first claim they say thanks
for the use of your premium dollars. The really annoying
part is that when he spoke to the insurance agent he indicated
that the reason he was looking for another company was because
of bad service with a claim at the prior company. Nice guys, huh?
Imagine what would have happened had the boat actually exploded?
Since then we have called in the Maryland Insurance commissioner
and are attempting to get the situation rectified. But, hey folks
better go back and check the dots on your i's and crosses on your
t's with BOAT U.S.
Some member driven organization! What a nice way to treat FELLOW
boaters, huh?

Allow me to get a few things straight:
1. he paid the premium.
2. they sent him and endorsed policy.
3. they renewd his coverage the second year.
4. Boat U.S is now saying he's not insured....

?: does BOAT U/S insure or do they offer insurance
in other words, is the problem with the carrier or BOAT US ?
I'm a BOAT US member but didn't bite for mailorder insurance because
the one quote I asked for was the same ballpark as current insurance
who has had no problem cashing my check each year.
If they use an insurance carrier, they should lobby for the
member, since the insurance company said they would NOT have
been covered, they should refund the $$$. You pay for a service.
I expect this was an honest mistake without intent to defraud, but
I'm sure the insurance company is within their rights NOT to refund
money if "misrepresentation" is involved. I think "fraud" is another
word for that, but that (to me) requires malice and forethought.
I'd be upset if it happened to me. BOAT US probably can't help,
now that I think about it (if they use a carrier) since the terms
are in black and white (ok ... so the words don't make any sense,
spend 8 years trying to get ready to cheat on the bar exam if you
don't like it MAJOR ;-) ok ?
My insurance carrier for years, who has my auto/boat/house now,
once listened to me complain to a billing problem (which was caused
by me trying to drive 2 cars and only insure one at a time because
I was young and insurance was expensive) when they mentioned that
I was violating NY State law concerning registration and uninsured
vehicles ... BUT they said they would have covered me in case I
had an accident (because I was young, cute and very stupid I
expect). Over the years they've said they'd cover me on two
other instances where paperwork said I wasn't covered but I have a
trusting face ;-)
Of course, I've never had to test their word ... but if they had
told me I wasn't covered per contract , and THEY would NOT have
covered me, I'd get red in the face and cancel my insurance and
probably pay 20-100% more in insurance to boot. It's the principle
of the thing.
I'm sorry to hear of incidents connected to orginizations I have
some kind of faith in (though BOAT US prices aren't all that
special anymore, they at least seem to care to do what they can
for me). Please keep us posted as to the outcome (if there
is more to come)
