I just receive some items I ordered from Boat/U.S in Maryland. On the packing slip I saw that they-Boat U.S-added sales taxes of 5%.Now,I am pretty sure this is the first time I've seen sales taxes witheld by them.Am I wrong and I didn't notice before that sales taxes were always there,or Duke's arm reached the other states and asked them to hold sales tax. for Mass.residents?

It has been that way since Boats r Us opened their store in Waltham. When a customer buys via mail order from an out of state company, if the mail order company has a normal place of business in Massachusetts you will pay Mass. tax. The same applies in virtually all states which impose a sales tax. Of course states which don't have sales tax (N.H. comes to mind) don't have reciprocal agreements. djc | |||||

State sales tax laws are generally written to cover ALL merchandise that is sold to end users within the state, regardless of whether the stuff is sold within the state, or through mail-order or whatever. Of course, an out-of-state mail-order company has no reason to collect Mass sales tax, since they don't conduct any of their business within Massachusetts jurisdiction. There's no way for Mass to force them to pay the sales tax. The state's position is that YOU should pay the sales tax directly to the state for this merchandise. They have forms for this purpose. If you are buying a major item that the state will find out about, e.g. a boat or a car, they will come after you for the sales tax. Now that Boat US has a MA store, they can no longer escape the state's tax bite. --RS |
