Although I am a powerboater, I think this topic is of more interest
to readers of this file. I have been disturbed by the provisions
of the marina contracts I have been asked to sign lately. Two of
the marinas, Tern Harbor in Weymouth and Cape Ann Marina in Gloucester,
have provisions stating they are not responsible for damage to my
boat (or my person) under any circumstances, INCLUDING THEIR NEGLIGENCE
OR BREACH OF CONTRACT. The third, Heron Way in Gloucester, not only
had this anti-responsibility provision but another that basically
said they could declare my boat abandoned and confiscate it at any
time, and then sell it to anyone for any price they chose. It seems
to me that only a legal moron would sign this latter agreement,
but agreeing to the former provisions seems unavoidable inasmuch
as it seems to be general practice.
Anyone else have any experience with this?
