 Freih Abu Middein, responsible for the Justice portfolio in the
 Palestinian Authority, said that the PA will impose the death sentence
 on any Palestinian involved in selling land to Jews or Israelis.  The
 Palestinian Legislative Council voted last week to authorize the PA to
 strengthen security and judicial frameworks in order to crack down on
 such land sales.

Mike, as you well know, I am totally opposed to the death penalty in any
case where it is not the only way to protect society (i.e. when a prison
isn't strong enough to prevent a specific criminal from inflicting further
harm).

The penalty is totally out of line with the crime.

Except for the penalty, though, this law is no different than laws in
the United States which are intended to prevent the takeover of low
income areas by affluent yuppies.

If Israel were not intent on inserting its population into Palestinian
areas, laws preventing sales of land would not be needed.  But under the
current situation, Palestine needs to take some action to prevent Israel
from building settlements all over its sovereign territory.

I would propose a 1000% tax.  That would slow down the purchases.

SAXTON ATTACKS NEW P.A. LAW AS ABOMINABLE AND ANTI-SEMITIC

Congressman Jim Saxton (R-NJ-03) today issued a statement about recent
reports that the Palestinian Authority (PA) intends to impose the death
penalty for Palestinians convicted of selling land to Jews or Israelis.

"The PA has, once again, demonstrated a brazen disrespect for basic human
rights. This piece of legislation is one of the most anti-Semitic laws
you could have.

"It is unthinkable in this day and age that somebody could be put to
death for the crime' of selling land to a Jewish person.  To make matters
worse, the United States is implicitly acquiscing in this policy by
providing funds for the Palestinian Authority-- the same Authority that
produced this abominable piece of legislation.

"This law happens to be a direct violation of the Middle East Peace
Facilitation Act, which requires that the PA respect civil liberties,
human rights and democratic norms.' I can think of no more basic civil
liberty than the right to sell one's land to whomever one chooses without
being subject to any penalty, let alone the death penalty."

Gibberish. Abu Middein clearly stated in an interview that the ban on
land sales to Jews includes the area within the "green line" (Israel's
1948 borders). "This includes all the cities - Jaffa, Ramleh, Haifa."
They also "do not accept" selling land to Jews by ISRAELI Arabs within
the green line.

I thought the idea of a "Jew tax" died with the fall of the 3rd reich.
We Jews have paid in blood for our land -- money will be a welcome
alternative no matter what the price.

** 4. ARMENIAN ARCHBISHOP BLASTED FOR LAND SALE

The Palestinian Authority is searching for an Armenian Archbishop who
sold his home on the Mount of Olives to American Jewish millionaire
Irving Moskowitz.

Earlier this week, Palestinian official in charge of judicial affairs in
the Authority, Abu Meddein said selling property to Jews would be a
criminal offense punishable by death.

Palestinian sources claim Archbishop Adjmian is a known agent of Israel
and his end will be death. Apparently a secret middle man acquired the
house from Adjmian situated on four dunams of land.

This morning, students of the Beit Orot Yeshiva began work at the site
which is to be intended to be a new yeshiva in the name of Rabbi Avraham
Yaakov HaCohen Kook.

Arabs in the Palestinian Authority who deal in the sale of lands to Jews
continue to be in danger.  The body of the Arab real estate agent Farid
al-Bashiti, who was murdered last week by Arafat's security forces, was
examined today in the (Israeli) Pathological Institute in Abu Kabir.  His
family was refused permission to hold a funeral ceremony in a Jerusalem
mosque, and the imam [the prayer leader] told them that he should be
buried next to the murdered Arab who sold his Jerusalem apartment to
Ariel Sharon some years ago.  

MK Chanan Porat (NRP) has joined his colleague MK Shaul Yahalom in asking
the Attorney-General to open an investigation against top Arafat-advisor
Dr. Ahmed Tibi.  They claim that Tibi's remarks against Palestinians who
sell land to Jews - "They have sold their soul to the devil" - constitute
incitement to murder.  Al-Bashiti was murdered the same day that Tibi's
remarks were broadcast.

In Ramallah, the body of a second realtor who sold to Israelis has been
found. Palestinian sources have identified the murdered man as 46 year
old Kharbi Abu Sara.

The body of Farid Bashiti, murdered two weeks ago, was finally buried
yesterday in the Judean desert. Ekhrama Sabri, the chief Moslem
religious leader in Jerusalem declared Bashiti an infidel for selling
land to Jews and said he could not be buried in a Moslem cemetery in
Jerusalem.

Israel has accused the Palestinian security forces of  "complicity" in

    Associated Press reports (11 May) that Israel has accused Palestinian
    Authority Chairman Yasser Arafat's personal bodyguard unit of killing a
    Jerusalem Arab who was suspected of selling land to Jews.
    
    Land dealer Farid Farid Bashiti was found dead Thursday in the
    Palestinian-ruled city of Ramallah north of Jerusalem.  His skull was
    crushed, his hands were tied behind his back and his mouth was sealed
    with plastic tape.
    
    His death came just days after PA Justice Minister Freih Abu Medein
    announced that Arabs caught selling land to Jews would face the death
    penalty.  "The death penalty will be imposed on anyone who is convicted
    of selling one inch [of land] to Israel.... Even middle men involved in
    such deals will face the same penalty," said Medein.
    
    "There is no doubt at all that Force 17 killed him," a senior Israeli
    official, speaking on condition of anonymity, told The Associated
    Press.  Force 17 is Arafat's personal bodyguard.
    
    Bashiti, 70, was seen at the Force 17 headquarters in Ramallah at 
    9:30 p.m. Thursday, the official said. "At 2 a.m. the hospital in 
    Ramallah phoned his wife and told her she could come and pick 
    up his body."
    
    Bashiti, said the official, was lured to a meeting at the Ambassador
    Hotel in eastern Jerusalem by a woman who said she had buyers for two houses
    in Ramallah he was trying to sell. Bashiti's family corroborated the
    account but denied he had sold property to Jews.
    
    About 20 Jerusalem Arabs have been kidnapped by Palestinian Authority
    agents over the last two years and subjected to rough interrogations,
    often including physical torture.  The Palestinian Preventive Security
    Service, headed by Col. Jibril Rajoub, has been responsible for the 
    abductions.
    
    The Israel-Palestinian accords bar the PA from any activity in
    Jerusalem.
    
    Meanwhile, Ikrameh Sabri, the Mufti of Jerusalem, the city's
    highest-ranking Islamic clergyman, said on Saturday that he had issued
    a fatwa, a religious legal ruling, decreeing the death sentence against
    Muslims who sell land to Israelis.
    
    In a sermon at the Al Aqsa mosque Friday, Sabri said Bashiti was an
    infidel who could not be buried at a Muslim cemetery. He also 
    forbade Muslims to pray for Bashiti at the mosque.

    The Jerusalem Post reports (9 May) that Beit Orot Yeshiva, a Jewish
    religious seminary located near an Arab neighborhood in eastern
    Jerusalem, has received as a donation a nearby house in the Arab 
    neighborhood of A-Tur.
    
    The house was reportedly purchased from its former owner, Armenian
    Archbishop Shahe Ajamian, for about $3 million by American millionaire
    Irving Moskovitz, who donated it to the yeshiva.  Ajamian has
    reportedly left the country.
    
    Students have begun to refurbish the home and contruct steps connecting
    it to the existing yeshiva building.  Arabs who noticed the work being
    carried out reported it to the Palestinian Authority.  Ahmed Tibi, an
    Israeli Arab who advises PA Chairman Yasser Arafat, called the purchase 
    extremely serious.
    
    Knesset Member Benny Elon of the Moledet party, director of Beit Orot,
    said he couldn't understand what all the fuss was about.  "We are on 
    good terms with all our neighbors," he said.

  Yassar Arafat has stated in an interview that he supports enforcement
  of the law forbidding the sale of occupied land to Israelis.

  While I remain opposed to the death penalty in all cases, I'd like to
  point out to American readers that if a similar situation occurred in
  the United States, Article III Section 3 of the U.S. Constitution would
  require a charge of treason, including the possibility of the imposition
  of the death penalty.

  If an occupying foreign power (holding, let's say, Delaware) sought to
  legitimize and make permanent its occupation by arranging for its
  citizens to buy land from Delaware's Americans and move in, those
  Americans who sold the land could rightly be charged under the U.S.
  Constitution with giving Aid and Comfort to the enemy.

  Until Israel and Palestine are at peace, the situation is identical.

In those areas outside its internationally recognized boundaries, Israel
is the occupying foreign power.  Israel's internationally recognized
boundaries do not include the West Bank, East Jerusalem, or Gaza.

    Think about it. You are being chased out of your land by the romains
    2000 years ago. Now you are coming back in your home country and you
    even pay for the land that is yours but which has been stollen to you.
    And what is the reaction ? Death sentence to the people who accept
    money for a land they received from somebody who has stollen it !

  You forgot to mention that "enforcement of the law" means enforcing the
  death penalty - with or without a trial.

  Not at all. Once again John is trying to whitewash the PA's corrupt
  activities with talk about "occupying" powers and legalistic babble
  which has nothing to do with the actual situation here. The PA may have
  the right to limit sales of land to Jews - even if such laws do have a
  stench of Auchwitz,

  however...  

  * Capital punishment for the crime of selling property to anyone is a
  flagrant violation of human rights.

  * The ban on sale of property to Jews extends to any Arab - not just
  those living under the PA's jurisdiction. Farid al-Bashiti was an
  ISRAELI citizen and not subject to the Palestinian authority. He had
  every right to sell land to whomever he wishes.
  
  * The ban also extends to land within Israel's sovereign territory -
  the selling of a home in Haifa to a Jew can hardly be considered
  treason by any modern definition of the term.
  
  * Those accused of selling land to Jews are not even brought to trial.
  They are kidnapped and murdered in cold blood with the PA's blessings.

  These are the people we are dealings with and it is these acts which we
  should all condemn.

 CONTINUED DEATH THREATS FROM PA
Head of  the PA Justice-portfolio Freih Abu Medein declared again last
night that the PA is determined to continue its campaign against Arab real
estate agents who sell land to a Jew.  He said that the PA will execute any
Arab caught making such transactions, including Arabs who are Israeli
citizens.  "Israeli Arab real estate agents are mistaken if they think that
their Israeli ID papers will protect them from the Palestinian Authority.
Those persons will be tried and punished by the Palestinian Authority.  We
will fight the selling of lands in Ramla, Lod, and other cities."   MK
Michael Kleiner of the Knesset Land of Israel front said in response:  "A
PA official threatens 20% of Israel's citizens with execution for selling
land to a Jew.  I call upon the Arab Knesset members to join us in the
campaign to defend those Israeli Arab citizens who are the subject of this
threat.  I have no doubt that if a similar threat were hanging over 20% of
American citizens, the U.S. administration would respond adamantly and
swiftly."   MK Chanan Porat has demanded of Prime Minister Netanyahu,
Justice Minister Hanegbi, and Public Security Minister Avigdor Kahalani to
prevent Abu Medein from entering Israel.

1. GOV'T BEGINS TO ACT AGAINST PA MURDERS
After a day of deliberations, Prime Minister Netanyahu has ordered the
issuance of a warrant for the arrest of a senior figure in the Palestinian
Authority - apparently Toufik Tirawi, head of intelligence.  The police
yesterday showed Mr. Netanyahu strong evidence indicating that Tirawi is
directly responsible for the recent murder of the Arab land-dealers.  Other
lower-level Palestinian Authority figures will be arrested in connection
with this issue, but the order to arrest Tirawi was held up by
considerations that it may arouse strong opposition and worsen relations
with the PA.  The Prime Minister met yesterday with Defense Minister
Mordechai, Public Security Minister Kahalani, GSS Chief Ami Ayalon, and
Police Commissioner Assaf Chefetz on this issue.

In the Knesset today, several MKs spoke out against the murders of the
Palestinian land-dealers.  David Azulai of Shas said, "Look and see who we
are negotiating with - people without simple respect for human life."
Rehavam Ze'evi of Moledet demanded that the government "severely punish"
the PA for the murders. 

2. PA TO PASS LAW AGAINST LAND-SALES
The Palestinian Legislative Council is expected within two weeks to
officially pass the law providing for capital punishment to dealers who
sell land to Jews.  Shlomo Filber, Deputy Chairman of the Yesha Council,
told Arutz-7 today that the law is a violation of the Oslo agreement on a
number of accounts. "The Oslo agreement specifically states that the PA may
not pass any law that has not been approved by Israel," said Filber.
"Secondly, no law may contradict existing laws in Judea and Samaria, or the
Oslo agreement itself.  The agreement states that the land rights of
Israelis and Israeli companies, even within Palestinian-controlled
territory, must be preserved.  This new law violates all of the above."
The law also calls for 'life imprisonment with hard labor' for foreigners
who participate in transactions of this type.  "This could be you and me,"
said Filber, referring to Jews who have bought land in Yesha.

9. FOREBODINGS CAME TRUE
Former Norwegian government minister Kaare Kristiansen, who resigned from
the Nobel Peace Prize Committee three years ago when it decided to award
the Peace Prize to Yasser Arafat, is visiting Israel as part of his efforts
to bring about the transfer of embassies to Jerusalem.  He said that Israel
is the only country to be "insulted" in this way by not having other
countries locate their embassies in its capital.  Kristiansen told Arutz-7
that "my forebodings of three years ago have come true."  He cited the
corruption in the Palestinian Authority, the continued terrorism, and the
recent killings of the Arab land-dealers as examples.
