27.0. "Info needed re: a get" by NIMBUS::FOX () Fri Oct 18 1985 15:03
Dear Khevre:
I am currently in the process of filing for divorce from my
non-Jewish husband. Although it's clear that my daughter is
Jewish _k'halacha_ (and has been/is being raised as such), I'm
unclear as to whether I need a _get_ (Jewish/religious bill of
divorcement) in order to remarry and have non-mamzer children.
NOT that I am planning either of these; but I'm only 31, and
recognize that people have been known to change their minds... :-)
If I do need a _get_, or some other formal statement from my ex
(such as a statement that he is not now, nor has ever been, a Jew),
I may not be in as good a position to get him to cooperate as I
am in now.
I am obviously not Orthodox, nor am I a _ba`alat tshuva_, since I
don't consider that I ever left. However, to avoid problems
that my children might later have, I would like to do this
according to _halacha_. (Flames on the subject of Orthodox vs.
Conservative vs. Reform can be directed to a different note).
If anyone can either cite a reference dealing with
this issue, or refer me to a competent rabbinic authority
(I live in Brookline, Mass.), please E-mail me with the information.
Thanks.
Bobbi

| Basically there is no doubt that a "get" is not required when either one of the
couple is not Jewish. The problem is more beaurocratic than Halachik.
If I may make a suggestion, I would try contacting the Bostoner Rebbe who
lives on Beacon Street in Brookline. His full name is Rabbi Levi Yitzchak
Horowitz. He is very kind and understanding as well as tolerant.
If you want more info you can send me mail TAV02::CHAIM.
I hope this helps you.
