1396.0. "Irish Refugee Bill" by ESSB::PBUTLER () Fri Jul 01 1994 05:00

	Yesterday, the Irish Government released for discussion its
	1994 Refugee Bill, new legislation to replace the 1935 Aliens Act. 

	Up to now, people arriving in the Rep. of Ireland seeking refugee 
	status had their application decided on by the Minister for Justice. 
	There was no appeal process against the Minister's decision, 
	applications took up to 1 year, less than 5% of applications were 
	successfull and applicants were held in jail while waiting for 
	a decision ( ie approval/ deportation). There have also been several
	cases in recent years of Russians & Cubans who refused to get back on 
	flights which refeulled at Shannon Airport being persuaded to get back 
	on board by local police without being made fully aware of their
	limited rights under the 1935 Aliens Act.

	The new Refugee Bill will have applications dealt with by a judge
	and 2 other civil servants with an appeal process involving a more
	senior judge. Appplicants will not be jailed while awaiting a 
	decision, will be entitled to minimum social welfare entitlements
	and will be entitled to the services of a solicitor. 

	This brings Ireland in line with the 1951 UN Resolution on Refugees.

	Commenting on the new legislation, Allan Shatter TD (Irish equivalent
	of Member of Parliment) called on the government to set up a commission
	to investigate how the 1935 Aliens Act had prevented Jews, escaping 
	persecution in Germany, from getting refugee status in Ireland. There
	was no immediate response by the Government.

    Not just Ireland - Jews were prevented from settling in the US for a good
    number of years before and during the war - ships were often turned back.
    There was a good documentary on this on public television six months or
    so ago...

unsuccessful flight of Jews (and some others) from Germany in WWII,
and how they were turned back at every port, see the movie or read
the book "Voyage of the Damned".

    This legislation is badly needed. Especially when you see how Money can
    buy you a passport here in Ireland. We had a recent case where a couple
    bought Irish nationality by investing #1million in a pet food factory
    owned by the reynold family ...say no more.
    
    Same time you see refugees from former Yugoslavia been very
    reluctantly allowed in (just a handful)...and a big deal made about it.
    To say nothing of folk from oppressed Sates been booted back onto the
    plane at shannon...bad news...
    
    hope this improves...for a country that has such a strong emigration
    policy...and is the first to complain if "we aren't loved" in every
    corner of the world we could tidy up our own house first
