748.0. "One more case to go" by SIOG::BRENNAN_M (Todays best labour saver - Tomorrow) Fri Apr 27 1990 09:41

I have just heard, on the radio that the Winchester 3 have been
freed by the British Appeal Court at the Old Bailey.

I understand that the conviction was quashed because the appeal
judge felt that remarks made by Tom King and Lord Denning (former
Master of the Rolls) may have predjudiced the trial. The remarks
were widely reported at the time and concernet the removal of the
right to silence. The judge felt that the jury should have been
dismissed at this point. The 3 were charged with conspiracy to murder
Tom King and other persons unknown.

Thanks for the info MBR. It seems that the system is starting to
falter when it comes to the innocent being imprisoned. Let us pray
this is only the begining and all suspect cases will be reviewed.

Not only was it unknown persons but it was conspiracy to murder unknown
persons at an unknown time in an unknown place.

Under the fair system of UK justice this warranted 25 years.

Hopefully the outcome of this and other pending cases will help to
restore some amount of trust in their justice system. I also hope this
will convince them to seperate their justice system from their method
    of government.

Had the original jury been sacked and another instigated with the
commit to ignore Tom Kings remarks on TV, its my feeling that the 3
would still be serving gaol sentences.... as Liam Ferrie points out
in the latest immigrant, most people probably consider that they were
in fact planning some subversive act. Strange how many tenets of a
reasonably good justice system (here) in England seem to go out the
window whenever the Irish are involved....
This case, in my opinion had a lot more substance (if one can believe the
"evidence" supposedly found on the 3) than that of the Birmingham 6.
The number of cases brought and proven against the West Midlands
serious crimes squad has caused an investigation into its methods..this
is the same squad which arrested the 6, yet all we hear are calls for
further evidence to be brought. Surely the discrediting of their general
tactics over the last 15 years is much more serious than the words of a
politician trying to alter the proceedings in criminal hearings.

    We wait in hope.........
