Subj: Communication Re: Military LOA
This is to inform you that an exception has been made to Digital's
Military Leave of Absence policy (Personnel Policies and Procedures,
Section 4.23) as it applies to employees called to active duty in
relation to the Persian Gulf crisis.
In general terms, affected employees will continue to receive their
regular base pay (including shift differential) for up to thirteen
weeks from their activation date. Upon their return to work, they
are expected to reimburse Digital for amounts equal to the pay they
received from the military during this thirteen week period.
In addition, these employees will be allowed to continue their
individual and dependent medical, dental and life insurance coverages
for this same thirteen week period. They will *not* be eligible for
sick leave, Short-Term Disability or Long-Term Disability during this
period.
In regards to the administration of this exception to policy, the
following applies to all employees called to active duty from
this date forward (see below for information on employees already
placed on Military Leave of Absence):
Step One
--------
When an employee notifies their manager that they have been activated
for military duty, the employee/manager should immediately complete a
Request for Leave of Absence form, indicating that it is a Military
Leave of Absence. The Leave of Absence Start Date written on this
form should be thirteen weeks from the employee's activation date.
The employee should remain coded Active ("A") on PAWS during this
thirteen week period.
The PSA/PA should send the Payroll copy (i.e., the green ply) of this form
to Corporate Payroll, PKO3-1/F12, Attention: Debbie Gomez, IMMEDIATELY,
along with a cover memo including the following information:
Employee Name
Employee Badge
Wage Class
Employment Status
Shift
Activation Date
Once this copy of the Request for Leave of Absence form and cover
memo are received by Payroll, the employee's name will be added to a
list of affected employees. Corporate Payroll will then keypunch the
employee's pay information each week for thirteen weeks, thus avoiding
the need for managers to submit timecards for Wage Class 2 employees
in order for them to continue to receive pay.
If the employee has elected Long-Term Disability coverage, the employee
must also complete a Benefits Authorization form, dropping this coverage.
The PSA/PA should delete this coverage from PAWS, effective on the
employee's activation date.
If an employee is receiving a live check from Digital, he/she should be
advised to immediately enroll in the direct deposit program. Pay statements
will continue to be sent to the employee's cost center, who will have the
responsibility of sending the pay statement onto the employee. Since pay
statements will most likely be mailed to an employee's home by the
cost center, they should not be live checks.
Employees should also carefully read and sign the attached agreement,
explaining the exception to the Military Leave of Absence policy. This
should be placed in the employee's Personnel file.
Employees should be reminded that if they have an outstanding SAVE loan,
a loan through the Digital Credit Union (DCU) or other outstanding loans
to a financial institution, that they should contact the appropriate
group/institution, as by law their interest rate may be lowered to 6%.
PSA/PAs should set up a tickler file containing the Request for Leave of
Absence form and a copy of the memo sent to Corporate Payroll, so that
at the end of the thirteen week period during which the employee is
receiving full pay, they may proceed to Step Two, below.
Step Two
--------
During the week that the Military Leave of Absence begins (i.e., thirteen
weeks after the employee's activation date, or a later date if our program
is extended), the PSA/PA should distribute the remaining plies of the Request
for Leave of Absence form and should place the employee on a Military Leave
of Absence on PAWS.
At the time the employee is coded on PAWS, the PSA/PA should also delete
ALL benefit information regarding the employee, as these employees will then
be ineligible for any benefits.
Please note that a Wage Class 2 employee on a Military Leave of Absence
continues to accumulate sick days. In addition, for all Wage Classes,
during Military Leaves of Absence, vacation days continue to accumulate
up to a maximum of two years vacation accrual. However, an employee must
return to Active ("A") status to become eligible for any vacation accrued
while on leave.
Step Three
----------
Upon the employee's return to Active ("A") status, the employee should
submit a voucher from the military to Corporate Payroll, PKO3-1/F12,
Attention: Debbie Gomez, outlining the pay they received from the military
for their initial thirteen weeks of military duty (i.e., the thirteen week
period during which time they received full pay from Digital).
Payroll will calculate the money owed to Digital. The employee will
then reimburse Corporate Payroll the amount owed with a Cashier's Check.
Please note: Digital will not include payments from the military made to
the employee for travel or work on Saturday or Sunday, when
calculating the amount of money owed to Digital.
Employees should complete a new Benefits Authorization "re-electing" any
coverages which were dropped at the start of the leave of absence and this
information should be input to PAWS.

For those employees who were placed on a Military Leave of Absence prior
to today, and since August 2, 1990 (i.e., the date the Persian Gulf
crisis began), the following applies:
These employees should be placed back on Active ("A") status immediately.
The PSA/PA should "undo" the Leave of Absence on PAWS, and send the
following information to Corporate Payroll, PKO3-1/F12, Attention:
Debbie Gomez:
o A copy of the Request for Leave of Absence, with
a corrected Leave of Absence start date (i.e.,
thirteen weeks from the employee's activation date)
o A memo including the following information:
Employee Name
Employee Badge
Wage Class
Employment Status
Shift
Activation Date
Dates for which employee needs to receive
retroactive pay (i.e., dates for which
employee had been coded on PAWS as being
on a Leave of Absence)
All benefits should be reinstated on PAWS, at the time the Leave of
Absence is "undone", and a copy of the latest Benefits Authorization
should be sent to John Hancock (or HMO, if applicable) explaining
that benefits should be reinstated back to their original effective
dates.
The PSA/PA should then follow the procedures outlined above, beginning
with Step Two.
Agreement
Whereas, the undersigned employee ("Employee") of Digital
Equipment Corporation ("Digital") has been called to active duty
with the armed forces of the United States of America as a result
of the crisis in the Persian Gulf resulting from the occupation of
Kuwait by Iraq, and
Whereas, Digital wishes to ease the financial burden of such
active duty on Employee during the transition from civilian life
to military life,
Now therefore, in consideration of the mutual promises made
herein, Digital and Employee agree as follows:
1. Digital agrees to continue to pay Employee his or her base
regular wages or salary, including shift differential if
applicable, as the case may be, for a period (the "Period")
of no more than thirteen (13) weeks beginning on his or her
effective date of active duty and ending on the earlier of
his or her deactivation date and the date thirteen (13)
weeks after the effective date of active duty.
2. Digital further agrees to provide Employee and Employee
dependents with continued coverage for the Period under
Digital's medical, dental, and life insurance programs
under the same conditions and at the same cost at which it
is provided for active regular employees for the same
Period. Employee is not eligible for Digital-provided
Workers' Compensation, business travel accident insurance,
short term disability programs or long term disability
during his or her absence from Digital.
3. Employee agrees upon his or her deactivation following his
or her period of active service to provide Digital with all
information needed to determine the amount of pay that he
or she received from the armed services for the Period.
4. Employee further agrees to reimburse promptly to Digital an
amount equal to the amount received by him or her
from the armed services for the Period but in no event more
than the amount received by him or her from Digital for the
Period.
5. Employee agrees to provide Digital prior to acceptance of
the benefits conferred herein with all necessary
documentation to show that he or she is a member of the
group for which this change in Digital's benefits policies
is intended, i.e., that Employee is on a military leave of
absence due to his or her activation with the armed forces
as a result of the call-up of reservists by President Bush
due to the Persian Gulf crisis as described above.

| That's what I heard from Personnel in CTC. It sure will help out. An
E-6's pay is a lot less than what I get at DEC. I heard that the US
Reserve forces have been extended for as much as two years. Another
source said something about "duration + 90 days". I don't know which
is right, but I guess I will be getting a "few" retirement points out
of this.

| Mr. Cheney said that while the latest Presidential authorization allows
for a two year recall, they are only going to keep people a year (so
far). They also said they would be sympathetic to special problems
regarding extended active duty.
I also heard that while I was in DC in September, particularly
regarding doctors who could come back to no practice if kept on active
duty for extended periods. But, it the war goes on, I suspect no holds
will be barred.

supposedly a Hot Line for Reservists to ask questions regarding legal
issues of being called to Active Duty. From what I gathered, it is
