357.0. "need a lawyer" by QUOKKA::9882::SCHLENER () Mon Aug 14 1995 08:42

My husband is looking for a good family practice (?) lawyer. He has
2 children from a previous marriage in which the eldest is entering
her last year of college. Now his ex-wife has informed my husband that
the eldest is planning on going to school part-time after she graduates
and that the ex-wife expects Dennis to pay child support up till the
eldest is 23. (First of all, I'm not sure the eldest is even planning
on going to school part time...)

However, we need to find out whether Dennis's ex-wife has any leg to
stand on regarding extending child-support past college graduation.
Also, she's now stating that she wants Dennis to pay for the youngest
    child's college education.

Currently Dennis pays child support along with an extra $2,000 a
semester for the oldest (the $2,000 was not court granted - just
    something Dennis wanted to do).

So Dennis wants a "truthful" lawyer to consult with and then if his
ex-wife make waves, a lawyer to fight her.

We live in Mass. and work in the Littleton/Acton area. Dennis would be
willing to travel just to find a good lawyer (something we haven't been
able to find in the past...)

P.S. According to things I've heard, I thought that a child going to
college had to live at home during the summer to qualifier as being a
dependent. The oldest daughter hasn't lived at home since she went to
school. Would that have any affect on a judgement?

Don't know of any lawyer in that area. "Good honest lawyer" seems to
be a bit of a nonsequitur :^}. As I said back a couple, the
justification used by most states for extending the "child support"
beyond the 18-19 year age is to provide money for college. Now to
come and demand money for college on top of that is a bit of a double-
dip. Most of the laws that I've seen state, "or until graduation".
Which would put the oldest out of luck.

The Colorado Supreme Court ruled that the child must be living at home
for the CP to collect the support. As always, your state may vary. If
your husband goes back into court, have him request that the support
be paid directly to the daughter(s). Sounds like the ex is seeing the
end of the gravy-train and is getting a bit desperate.

She has to pay for her 2 boats, Maine vacation house and land in
Florida... What ever lawyer we find I'd like him/her to check out the
fact that the oldest daughter hasn't lived at home for 3 years. I
didn't think that my husband's ex had a chance with extending the child
support past graduation but in Mass. you never know.

Anyone out there - any lawyer recommendations???

Not being from your area, I can't help much in that area. As I said,
a good lawyer, especially one that will fight for the father, is hard
    to find.

Might try some of the local father's rights groups. Check notes
    38, 135, 202, 159.3, 191, and 270.

    Anyone else?

357.6Lawyer referral program?QUOKKA::15838::JACQUES_CACrazy ways are evidentMon Sep 18 1995 14:5812
In an older note, someone mentioned something about a free
consultation, or lower rates, or some benefit from using
the (a) lawyer referral program? Can someone direct me
toward one of those, or provide a phone number? Is this
some program DEC has in place?

I know when I called for a consulation with a NH lawyer, I
was asked up front if I had been referred. Now, I may need
instead a MASS lawyer. Or one that practices in both states.
But any financial break I can get is appreciated.
