My brother cam home from work on Friday to find out that his wife has filed for divorce. Are there any UK readers out there who can give the latest info from a male position in the divorce stakes in the UK. What age could a child be asked which parent does it want to live with etc. Is there any advice that I can give him. Any information greatly appreciated. From what has happend up to now we know she is going to play it very dirty. Does mummy still always will. I am assuming that she will win and just want to make sure that he gets a fair hearing. I'm no expert but when when my husband went to court to stop his ex wife taking his son with her when she was moving out of the country, his son was ten years old. He would have been asked where he wanted to stay but he made that clear before it came to court. So I take it that around the age of nine or ten, the courts ask for the child's wishes to be known. My stepson has been with us for over five years now. I don't think that the mother always wins but she is more likely to be granted custody unless your brother can prove that she is an unfit mother. Going on my husband's experience, he's best to get a good lawyer, not rock the boat with his wife, be as generous as he can with maintenance in the meantime until the courts decide how much he should pay and not be seen to be playing dirty back. My husband was generous with paying bills, etc. up to the court case and that was looked on very favourably when his ex tried to get more money out of him. Tell your brother to make sure he keeps receipts for any bills he pays so that his lawyer can produce these as proof in case she tries to say he didn't pay anything.
