Probate Court - has there ever been a system so out of control?
I've been on both sides of the fence. As a divorced
Father and also as someone who married a divorcee that
has to deal with a deadbeat..

Best thing is to write your congressperson and senator and ask to have
Probate courts added to the base close-ure list!:) Go around and spray
paint over the court house, Fort (town/county name).

There was a lengthy article in the Boston Globe (11/26) describing what
a farce the MAss probate court is. Judges complaining that they're
overworked and that they need more.
Funny thing...I thought when you had a business problem to solve you
first looked at the performance of the people you already have, rather
than automatically assume you need more people. Sounds like the Judges
aren't accountable to anyone - many admitted that by the time they got
around to making a ruling on a case they had forgotten what the thing
was all about.

Is there an appeal process for probate judge's rulings in MA? I
brought contempt charges against my ex last spring, it got dragged out
through the entire summer, and the bottom line (although she admitted
in open court that she took visits away from me, prevented my daughter
and me from seeing each other on numerous occassions, has no intent of
discussing how our daughter is raised with me [all of which is a direct
violation of our divorce agreement]) is that the judge wrote a decision
that didn't even address any of the issues but still decided that she
is not in contempt and I should have to pay a portion of her legal
bill, based on her untrue statement that I have verbally abused her.
It's not only the money, it's the fact that there's a black mark
against my name due to some senile judge who forgot what the whole case
was about by the time he got around to making a decision.
And what if I don't pay the bill? (His order says to pay it, but
doesn't say by when, in what currency, what denominations, etc - can I
have a truckload of pennies delivered?)

There is an apeal. And you should seek it. And its tuff and long. But,
its worth it if you are denied. Keep documenting every time your denied
visitation. Get a friend to also take a video recorder on these
denials. Document every time she denies you a chance to talk to your
daughter via phone....
