321.0. "Daughter moves in with dad." by QUOKKA::29881::LEBLANC () Fri Aug 12 1994 09:54

Anyone know what the percentage I would have to pay if my teenage
daughter comes and lives with me? I currently pay about 30+ percent.
Our 12 year old son lives with his mother and her boy friend. I
guess I want to know if the percetage will be dropped due to the
fact that I have my daughter living with me.

What state do you live in?

Call the DOR/DCYS/etc and find out.

I rather doubt that there will be a childsupport reduction. But, if
there is. And you get a court order and something doesnt go down the
right way. A co-worker here got really miffed when his last son was
working, out of school, and was paying child support. He called the
Gov of Mass. and got action!! YES! He made his last child support
payment about a month ago. And it was as legal as an eagle!:)

Most states go by "guidelines" in setting child support. The amount
paid usually depends partly on the number of children supported. So
I'd expect some amount of reduction if you should get custody changed.
If you don't get custody changed, you may have to continue paying
the same amount even thought the child is living with you 8-(. If
you get a reduction, it may not be by half (for two kids) since the
guidelines don't usually allow for paying more for the first child
    than for subsequent children.

First legal custody must and should change. In conjunction with
that the support will be recalculated, with the guidelines in the
background as they don't directly address the case where each parent
has custody of a child. The biggest single factor would be the $15,000
deduction for the custodial parent since each is entittled to it nulling
the affect out. In this case the bottom line is if an agreement
between the parties can't be reached it all boils down to what judge
you get and the relative earning powers. It could vary all the way from
no child support either way (if earning potential is similar) to only
a modest reduction if the earning power is greatly different.

My daughter will be 15 this month. Is she at a legal age to decide what
parent she wants to live with?

Yes. And must formally state it in the legal manner thru the proper
    channels of your state.
