On the front page of today's (2/8/94) Boston Globe they have an insert article about a 28-year old father of a 1-year old who is attempting to gain custody of his child by saying his ex-wife is endangering the health of the child by her smoking habit. The child has bronchial and respetory problems and he has medical records and testimony of a physician stating the relationship of second-hand smoke to the well being of the child. Any thoughts ? IF the goverment says second hand smoke is dangerour. Then he has every
right to protect the child.
And if the kid has a problem with breathing, the father is doing what
is in the best interest of the child. Or mom should quit smoking fast.

I've _heard_, but not been directly involved in, cases where smoking
has been an issue. The issue being that the smoking parent is
endangering the health of the child by smoking. Some cases have
worked; some haven't. However, it could be the swing vote in a
close situation. That is, I would not make it the only issue, but
I would make it one of the issues since there _is_ growing evidence
that second hand smoke is a danger. If one person is more "qualified"
(depending on what you call qualified) other than smoking, it may
not make a difference, but if it is a close call and the other parent
made a big issue out of it, it may be the difference.

What a nerve this hits with me. My X refuses to stop smoking around
my two boys. I am currently trying to save enough money so I can afford
to take her to court for custody. She smokes in the car with them and
being a "reformed" smoker I know what this feels like. My only problem
with this is this is the only issue with my X that I have and the
courts the way that they are in "MASS" probably won't consider this
enough of an issue to give me a chance.

In your casw you have to remember, that the courts view her 'pure as
driven snow' <minus any acid rain.;) > and your the bottom of the coal
bin.
