    I got some suprising news today.  I talked to my ex-mother-in-law and
    she was very surprised to learn that I was paying child support.  She
    insisted that my ex-husband never received AFDC from the state of North
    Carolina.  She said she paid all his bills during the time he was out
    of work and she has the receipts.  She feels that my wages are being
    garnished in error.  I am mailing her all the paper work tomorrow and
    she is going to take it to the office and get it straightened out.
    
    This is what I believe to be the true scenario here.  My ex-husband did
    in fact receive AFDC.  I have the printout of the months and amounts he
    received welfare.  He lied to his mother about receiving it.  Keep in
    mind that my ex is not long on being responsible and is excellent at
    conning people.  In my gut I believe he conned his mother into paying
    all of his bills and then used welfare for whatever.  Either way, this
    could mean that HE, not ME, will have to pay back the state.
    
    I'm not getting my hopes up here, but it sure will be nice if the
    garnishment is stopped.  I guess I should keep in better contact with
    my ex-mother-in-law.

    Interesting.  If he has indeed been collecting from AFDC *and* his
    mother, he has been committing fraud on AFDC.  They are likely to
    not take very kindly to that ( read criminal charges ).  
    
    I just finisned fighting the state of Minnesota to a standstill 
    over a similar problem.  It seems that my ex was collecting AFDC
    for two months after I got custody of the children.  The were
    trying to attach my tax returns to pay the "child support".  
    Last July I sent them the papers showing I had custody and my
    child support was stopped ( good thing I got an order signed on
    stopping support instead of just letting it go ), *and* a payment
    schedule from the court showing *all* my support payments had 
    been made.  
    
    At my wife's urging I made a follow up call last week. The woman in 
    the child support enforcement section told tried to tell me I *still* 
    owed the "back support".  I told her she'd better go look at the papers 
    again.  She tried to tell me she didn't get the papers.  I told her 
    that I'd sent them registered mail *and* I have the receipt, so she 
    d*** well did too have the papers and they d*** well *did* show that 
    I did not owe anything.   She said she'd check it out and call right 
    back.  About 30 min. later she called back and said that they *were* 
    dropping the attachment.  I asked her to send me a letter that they 
    were dropping the attachment in case there was any hasstle with the 
    IRS.  She said that she'd do that.  No letter yet, but all this just 
    took place Friday.
    
    Moral of story.....DOCUMENT, DOCUMENT......DOCUMENT.

    I don't know, but wouldn't he be defrauding your ex-mother-in-law?  I
    mean, does AFDC really care what happens to the cash once they give it
    to him?  I don't know, I'm genuinely asking here.
    
    I do know, however, that if you weren't paying to AFDC, and you paid
    directly to him, you'd have to have all your receipts to prove it.  My
    ex went through that routine, they threatened to throw him in jail so
    he had to take all his receipts (cancelled checks) down to them and
    show those fine Welfare folks.
    
    I think it's your ex-mother-in-law who's been getting the shaft here.

    Jean,
    You are right.  I think the only time AFDC cares is when they are on
    both welfare and working under the table and they get caught.  All AFDC
    really cares about is getting their money back, this is a real hot
    button with me.  If I had stayed on welfare, I could have gotten help
    in getting my child support, when I had the child care, the high
    doctors bills due to my son's ashtma, etc., etc.  But since I chose to
    be responsible and actually work for a living there was no help
    forthcoming.  Like I said this is a *real* hot button for me.  My
    ex-husband knows how to play everyone, from the system right on down. 
    And then points his finger and talks about how *HE* has been
    victimized.  Give me a break!
