Hi All, John and I just found out that his ex quit her job. She has not told him of this yet, but he has confirmed this by calling her employer. Thier daughter also confirms this, but she is four so we really can't count her version of this story. A few months ago he was brought into court by DOR per request of the ex to have his wages attached, to have him pay for Erin's medical insurance, and to have the arrears decided upon. He did not get his wages attached per order of the judge. He was not ordered to pay for her medial insurance per order of the judge. The arrears amount was decided upon and the schedule to pay was set. Last week his personnel office notified him that they had received a requst for a financial statement from DOR through NY DOR. It stated that if a request had been made within the past four months to ignore the letter. So he called DOR and was told to ignore the letter as he had a court judgement within four months. Needless to say all of the pieces are falling into place and we are beginning to see what she has planned. From our summation, she has quit work for the summer as Erin will be starting kindergarten next year. She wanted him to pay for Erin's insurance because she knew she was not going to be covered when she quit/left her job. She wants more money from him because she is not working and will need the money. 1. Is there a way that this can be used to his advantage? IE can this be seen by the courts as a deliberate act which would endanger the well being of thier child? 2. Does her quitting her job have an effect on the amount of support he will be required to pay? 3. Does her not having a job make him legally responsible for providing the child with medical insurance? Quiting a job is volenteer (sp) un-employment. And IF you make that point made. It may have an effect on the out come of the battle. Gotta understand her (ex's) next move might be alimony, unless she is remarried. Then yes expect your child suport to go up. Relax, take a deep breath, and find out what you can about the ex and her job quitting. Remember when you mess with the best, you die like the rest. Get tuff! | |||||

She may try to get his support increased, but since she just tried and failed, and *voluntarily* quit her job she *shouldn't* be able to. Update: John spoke with the ex last night and asked her why she left her job. She stated that she wanted some time for herself and has decided to temp for a while. Once before she threatened to leave the state and take Erin. John went into court at that point and the court awarded him temp custody. We both think that she is planning on doing this again, but we can not confirm it. She has been talking about moving to California for the past few months. He is going to speak to a lawyer today to see what his next step should be. I think he should go in with a motion to gain temp custody again because I honestly think she is planning on relocating to the west coast. Will let you know what happens. Michele |
