    I am entering a note for a friend that is looking to reduce
    child support payments in MA. He currently lives in N.H. and
    knows that he must refile in MA. The questions are. Is there
    a standard form that he can requests from the courts and the
    procedure to go it alone to submit. Also how long a period
    of time does one need to show pay stubs/and cost of living
    records when approching the court. I am assuming the ex
    is notified by the court for her input to the possible change.
    
    		Any help would be appreciated.

    He has to go to the court that services the district that the divorce
    took place in. Yes, there is paperwork to file for a pro-se lidigant.
    And it isn't a big deal to do.

    	When looking to reduce child support payments, your friend must
    	make sure that he can prove that his financial circumstances have
    	change enough to warrant a reduction. Changes such as a reduction
    	in income. But even this must be justified; he can't just drop a
    	high-paying job to work at McDonald's in order to lower his pay-
    	ments. Also, if he decides to by a $500K home and his expenses go
    	way up as a result, well, I don't expect the judge will look at
    	that as a valid reason to lower support.
    
    	But if he has a valid reduction in income, there is no 'waiting
    	period', per se. He can go in the day his redced salary takes
    	effect.

    a bill preposed by this fathers group for welfare reform is:
    
    -sole-father custody in situations here mothers apply for welfare and
    the father has a job that is capable of supporting the child(ren)
    
    -and because it is asked that mothers be treated equally, in that they
    should be required to financially support their children, i.e. repay
    the goverment for welfare benefits.
    
    Currently, the goverment only requires one parent to repay welfare
    benefits and that is based on the sed of the parent. (Male). 
    
    Sounds like a good idea to me esp if the country is looking for a
    reform.

    George,  does that mean that if custody is changed to the father,
    the non custodial mom has to pay child support?  Usually non-
    custodial moms don't pay child support.
    Maybe that should be tacked onto the bill!

    NC moms are already ordered to pay child support.  It's just that
    a higher percentage of them than men are "deadbeats", and it is 
    much harder to collect from them since it is easier for them to
    be "unemployed".

    I am not sure were this group is at the moment. Try reading the web
    page on them. I feel that they are hoping to bring about a fair and
    just divorce system. Women can go onto welfare easier than a man with
    custody. Men are also less likely to ask for help in this reguards
    also. But, the push is welfare reform. The Great Society of LBJ has
    failed miserably. And there is no real good solution being brought
    forth execpt, lets study it for the next 30 years and then tell you
    that we need to spend more money for it.:) When simple fix's can be
    allowing men a fair shake at it. Despite what many feminist seem to
    crank about men not being able to nurture. Studies have seem to surface
    via this page and other sources, that women can handle some of it, but
    when it comes to teens.... well let the stats fall where they may.:)

    	They are two different issues. What do you mean when you talk
    	about 'repayment' of welfare benefits?

    If you are collecting "welfare" (actually A.F.D.C.--aid for dependent
    children).  Then any child support payments must be turned over to
    Social Services (aka, Human Services, aka Welfare).  Actually this
    applies to _any_ income.  Welfare will be reduced by the amount that
    an individual makes working (so why work?).

    If you have the Social Services go after the "deadbeat" and collect
    the court ordered child support, then they will keep the child support
    until all back payments owed to them are collected.  Even if the
    CP leaves welfare, Social Services (anybody note the irony that they
    have the initials S.S.) will keep the payments until all back payments
    owed them are collected.

    One of my former tenants filed for AFDC, and the local Dishuman
    Services sent me paperwork for me to sign to who/whom lived in the
    apartment. There were two adults and one child. The tenant stated one
    child and one adult. I made a photo stat copy of the document that I
    had signed to state the truth, the changed it. And when I was called on
    the capet over it, showed them my copy, the original. Next!
    
    Another one wanted to open a day care business in her apartment. And
    got upset because I didn't want her to have more than the legal amount
    of children you can have in a unit before you had to formally get a
    license to operate. Bad landlord, baaad man!! Baaad! Hence she got shut
    down, and left the place trashed.... Baaad man@!!
    
    Still another wanted me to turn my head the other way, lie to
    AFDC/Dishuman Services, about her beau living with her. Hey not my
    problem till I am held accoutable for it. As in sign a legal document
    and if I lie, It will be My building that will be taken away. it will
    be me who will go to jail for defrauding the local goverment. NOT!!!
    Sounds like the whole thing needs a revamping, from get-to-go....
