| Does Maynard REALLY NEED to issue another license to sell alcohol?
Doesn't the town have a limit as to how many licenses they can issue?
Maynard already has SO MANY places where alcohol may be purchased.
Just curious to know if the town government has ANY concern about this
subject or if they just want the $$ they get out of each license they
issue?

note for agendas of town agencies.
The issue of vice licenses for tobacco or lottery or liquor sales
is another topic, and I respectfully request that you open another
note for these discussions.
I think that the discussion could be interesting so I encourage you
to open a new note on this subject.

we will be looking at an override question for FY93.

Could someone explain to me why you can't balance your budget with
School Choice? While there are clearly differences in the per pupil
costs of the systems involved, fixed costs in Maynard can't be more
than 10%-15% of the total school budget. Is the superintendent
contending that he reuires additional funds (beyond level funding)?
Having lost some revenue but apparently not reducing the budget to
reflect some of the loss of population seems to be saying that the
problems are so severe that twice as much money is needed to respond
to the problem. I'ld contend that taking the per pupil cost and
multiplying it by the number of students plus a percentage increase
will still bring you to a lower figure than the current year.

| I have a correction and a clarification on 342.5:
Correction: I had my dates wrong. The monthly joint meeting of
the Selectmen and the School Committee is next Tuesday, January
21st, not the 14th as I posted. The Selectmen will continue
their Budget review following that joint session.
Clarification: I understand that a member of the School Committee
took exception to my comment that "the issue of School Choice will
weave it's way into both topics".
For the record, I was not posting that comment as an agenda item,
only as a personal observation. As far as I know right now, there
is no "formal" agenda for the joint meeting.
My sincere apologies to the School Committee for any offense or
confusion that this personal observation may have created.

NOTE: Willis Bean has submitted his resignation to the Board
of Library Trustees. Since his is an elected position, the
Charter requires that this vacancy be filled by a joint vote
of the Library Trustees and the Selectmen. I'm not sure what
the pleasure of the Board of Selectmen will be, but I suspect
that there will be discussion on the process and timing of
filling this vacancy. If anyone is interested in filling this
slot (one year remaining on this term), I suggest that a letter
of interest be submitted to the Town Administrator.

(These interviews will be held in joint session with the School
Committee and will result in a replacement for Bob Geldart,

| I forgot to enter tonight's Selectmen's Agenda, so here it is,
after the fact....
6:30 - Voted to transfer the Beer and Wine License for Bud's
Variety from Ty Nguyen to Dilip Patel. The convenience store
is being sold and the application was to transfer the license
to the new owner.
7:00 - Voted to transfer the Maynard Cable TV license from
AR Cable Services to a reorganized Company under the same
general management structure. This was a legal process that
allows the existing cable company to re-structure it's finances
with a new investor. This does not alter the present cable contract,
its terms and conditions, or its renewal process with the Town. I
should note that Joe Magno attended the meeting and noted that over
$10,000 in new equipment has been added to the WAVM studio in the
past month which will greatly improve our already excellent High
School facility.
8:30 - Executive session to discuss a personnel issue. As you can
understand, there is no comment on executive session discussions.
Other actions taken:
Voted to accept the Police Chief's request to transfer a police officer
(Harry McMahon) from the Gardner Police Department to the Maynard
Police Department to fill one of two existing vacancies. This is a
Civil Service process which has been done several times in the
past. It permits a town to gain a qualified police officer without
incurring required training expenses. It our case, Officer McMahon
will replace officer Mark St. Hilaire, who transferred to the Natick
Police Department through the same process.
Voted to ratify the Town Administrator's appointment of Carolyn
Marcotte as Treasurer/Collector. Ms. Marcotte is presently the
Treasurer/Collector in Hopedale, MA. This position reports to
the Town Administrator under the provisions of the Town Charter.
Voted to support a grant application to be submitted to the
Massachusetts Office of Communities and Development on behalf of
the Towns of Maynard, Boxboro and Stow. This grant, if approved,
will provide funds for the creation of a Regional Dispatch Center
for the three communities for dispatching services for Fire and
Ambulance Services for the three communities. The Town of
Boxboro is the lead community in this application. The Town of
Maynard voted in favor of this concept at our 1991 Town Meeting.
Voted to exempt Paul Howes from the prohibition of receiving
financial compensation in his duties as Head Basketball Coach at
MHS while serving on the Maynard School Committee. This is the
second of three steps required by the State's Conflict of Interest
Law. The first step required that all School Committee members
be designated as "special municipal employees" by the Selectmen,
which was done at the June 29the Selectmen's meeting. The third
step is that Mr. Howes is required to submit a letter to the
Maynard Town Clerk, openly disclosinng his financial compensation
from his duties as Coach, in accordance with the provisions of
Section 20d of Chapter 268A of the General Laws.
Regarding the above, I gave a report to Town Meeting in May,
noting that the Town did not need a by-law to address conflicts
of interest and codes of ethics, since the Commonwealth already
had a very good Law (Chapter 268A) in place. The ruling from
the State Ethics Commission was very well done and covered this
unique situation with extreme detail.
Finally, the Town Administrator received a letter of thanks from
Boston Edison, thanking him for his support during the recent Energy
Fitness program in Maynard, which resulted in the installation of
energy conservation measures in 599 homes in Maynard.
I know this was long, but now you don't have to buy the Beacon!

| Oops, forgot to post the agenda again, but the Selectmen's agenda
was light this week and here's what happened:
7:00- Representatives from the Sudbury, Acton, and Stow Food
Pantries, Maynard's Agape Center, the Maynard Emblem Club, and
the Acton Community Supper program met with the Selectmen to
discuss the need for a Food Pantry in Maynard. The Selctmen
were shocked and saddened to learn that up to 35% of the food
recipients at our neighboring Food Pantries were Maynard
residents. While it may be that some of the people in need in
Maynard are too proud to seek assistance within the town and
go outside of town to get food supplies, the fact remains that
we have a lot of folks that could use assistance, in addition
to the fine efforts of our local volunteer groups.
While the operation of a food pantry does not fall under the
jurisdiction of the Town of Maynard or it's government, the
welfare of the citizens of the Town is of prime concern to
the Board of Selectmen. In addition to a vote of support for
the creation of a food pantry within the Town of Maynard, the
Selectmen directed the Town Administrator to set up a meeting
with the various religious and fraternal organizations and
the Board of Selectmen to kick off an effort to establish a
food pantry in Maynard. Ed Gottman of Our Lady of Fatima Church
in Sudbury, Coordinator of the Sudbury Food Pantry, agreed to
assist in the program and he will bring in representatives from
Project Bread, a grant agency that provides funds for start ups.
A reporter from the Maynard Beacon was present and I'm sure you'll
read and hear more in the coming weeks about this.
Other actions by the Selectmen included the re-appointment of
Marilyn Fedele and Robert Tallent to the Board of Registrars,
Florence Tomyl to the Recreation Commission and the appointment
of Bob Macomber to the ADA Commission.
We also voted to send a letter of praise and thanks to the Fire
Dept. and Police Dept. for their efforts in last Saturday's
Plane Crash. Letters will also be sent to the Acton, Concord,
Sudbury and Stow Police Departments for their prompt response
to the radio report of the crash. Our neighboring towns were
immediate in dispatching cruisers and officers to the scene.
Finally, in a roundtable discussion, I asked the Town Adminstrator
to schedule a meeting with the Recreation Commission to address
the growing need for more playfields in the Town. Both the
Assabet Valley Little League and the Maynard Soccer Boosters have
voiced concern about the available space in Town for youth sports
and other active recreation.
Rather than clog this note with a discussion on recreation space,
I will open a new note to get input.

Among the correspondence received was a letter from the State DPW
advising us that we can paint the interior of the crosswalks in
town in whatever color we want, as long as it conforms with the
State standards. We had requested the Town DPW to paint the
crosswalks green, and hopefully this will be done before school
opens.
Other correspondence included a copy of a letter sent by the Fire
Chief to his firefighters praising them for their outstanding
efforts in the recent High School fire.

I was wondering if Maynard will send a letter to each of the other
responding communities for their help, just as we did for the plane
crash (below):

| Regarding -1: Karen, I never did check to be sure, but I do
recall that a letter of thanks to our neighboring towns was
one of the first items mentioned in the after-fire review.
I'll confirm that this did, in fact, go out.
We were very thankful to all the towns who responded to our
call for help that night. As I mentioned previously, in
addition to all the equipment that assisted, I think that
the Fire Chiefs from two or three neighboring towns zoomed in to
aid in the fire.
This is a prime example of the excellent mutual aid system that the
area towns have used for many years. As another example, recently
the Town of Acton has had to place severe weight restrictions on
the South Acton railroad bridge. This means that in any fire
emergency south of Route 27 in Acton, Maynard will be the first
response, while Acton units go around the bridge to get to the
emergency. We had a similar aggreement with Concord several years
ago when the Damondale Bridge on Route 62 was undergoing
reconstruction.

Discussion on School Choice
ACTION ITEMS:
1. School Committee Request- Names for School Property
[ The School Committee has voted to name the High School Driveway
"Tiger Drive" which will give the High School a new address
(#1 Tiger Drive) and now the Selectmen have to approve the School
Committee's request, under Chapter 85, section 3A of the Mass General
Laws. The School Committee has also named the path between the High
School and Alumni Field "Victory Lane".]
2. Elks Proclamation
3. Request- Sewer Tie-in - Elaine Avenue Property
[This is a request from an out of town (Stow) property to tie in to
the Maynard Sewerage System. A few months ago, the Selectmen voted
to extend the Town's Sewer system up Elaine Avenue into Stow to
serve a proposed new house ( the homeowner will pay all the expenses
for the extension). This request is for a tie-in to that line and the
requestor will work out the financial details with the other homeowner.
The Town of Maynard will incur no expenses for this project, although
all construction will be in accordance with our construction standards
and will be monitored and inspected and approved by our DPW.
There will be perhaps two more requests from abutters on Elaine Avenue
for sewer tie-in permits. All are currently served by the Maynard Water
System and all will pay the current "out of town" rates for both water
and sewer. There has been a history of septic system problems in this
area and the conversion to the Maynard Municipal system will improve
the environmental conditions in this area.]

As you may know, the Town of Maynard now requires that at least one
on-duty employee in any establishment that serves liquor be trained
and certified by an approved Server Training Program. The Town has
sponsored two training classes so far and the following is the list

This a great start. As an attendee I can tell you that the training
is well worth the time spent. In addition to learning how to spot
fake ID's, the training helps to identify when a patron has had too
much to drink, and what to do if you wish to shut off a patron.
The certification is good for three years.

Our new Treasurer/Collector, Carolyn Marcotte, is now a Certified
Massachusetts Municipal Treasurer, having attended the required
four year training program at UMass-Amherst.

| The Selectmen's meeting this evening was brief.
We had a scheduled Executive Session to discuss a Personnel issue,
which was postponed.
We also had a Hearing toiscuss the revocation of the Beer and Wine
license for Salamone's Market. As I've stated previously, this is
related to the original Salamone's Market next to McDonald's at the
east end of Main Street and does not involve either Russell's
Convenience Store or the Salamone family.
Back in November, the owner of Salamone's sold the store to another
party. No application for transfer of the beer and wine license was
submitted, so the Selectmen suspended the license at that time to
allow for the submittal of a transfer application. Tonight, neither
the original owner nor the new owner appeared at the hearing and no
paperwork has been received, so we revoked the license completely.
This means that all existing beer and wine stock at the site must
be removed from that location.
In other news, Brown's Auto Body has donated a car to the Police
Department for the use of the Youth Officer. This vehicle will be
lettered to promote the DARE program, and will be used for official
business by the Youth Officer. The Selectmen approved the donation
with the understanding that this does not become a permanent addition
to the Police fleet. That is, if and when this car wears out or needs
major repairs, replacement or repairs will also be by donation, and
not from Town funds.

7:00- Board of Health - Solid Waste Proposal
(NOTE: The Town of Maynard's Solid Waste Collection and Disposal
Contract will expire in 1995. At that time a new State Law will
take effect mandating recycling. We are faced with either curb
side recycling or a transfer station. The Board of Health will
be presenting a proposal on both options.
After that, we will review the preliminary FY94 Budget, which was
submitted by the Town Administrator on January 1, in accordance with
Charter requirements.
The Maynard Selectmen will meet with the Stow Selectmen in Stow on
Tuesday to discuss various service/ facility regionalization issues.

| One correction and one update:
Mandatory recycling will take effect July 1, 1993, not 1995.
The Maynard Board of Selectmen did meet with Stow and Boxboro
officials this evening. However, the agenda was really a discussion
on the Regional Fire Dispatch Center Project, and only briefly did
we discuss a Regional Police Facility for Maynard and Stow.
The meeting raised a lot of questions about the cost savings of
a Regional Fire Dispatch Center, and the three Fire Chiefs will go
back and do more research (business plan?). Obviously, there is no
way that any town would support a regional plan that would end up
costing more money than we are now spending.
Maynard and Stow Selectmen will schedule a separate joint session to
discuss the possibility of a regional Police facility. The first thing
we need to do is agree on the concept or agree that the two towns should
go it alone. We have not had that discussion yet. One way or the
other, we can then tie in our Building Needs Committee and their
research.

8:00- Maple Street Residents- Residential Park Proposal
The residents of Maple and Brooks Streets have proposed a small
park for the former railroad right of way at the corners of Maple,
Brooks and Summer Streets. This location was previously proposed
as a parking lot to be developed by the owners of the Maynard Mall.
NOTE: due to my involvement in the Knights of Columbus, an abutter,
I will excuse myself from this discussion.
After that, we will go into Executive Session to discuss sale of Real
Estate.

NOTE: The Corner Store has done some renovations and has moved
the location of their beer and wine storage room. The State
ABCC requires that liquor licenses identify storage locations,
so a public hearing must be held to approve the new storage room.

Discussion on Water Filtration.
NOTE: Federal Law requires that surface water supplies must
construct water filtration systems. The meeting will discuss the

I've heard some talk that the town shouldn't allow the circus because
of past problems with the carnivals that were sponsored by the American
Legion. I would think that's like comparing apples and oranges. The
only common denominator between the clientelle of the two would be
young children and parents. You wouldn't have teens from the entire
area carrousing the place which was a reason for a lot of the trouble at
the carnivals.
And let's face it, there are a lot of "strange" characters that turn up
at carnival events.
The biggest problem I see would be the potential damage done to Crowe Park.

| IN regard to the Circus, there have been Circuses in the Town on Crowe
Park since the Carnivals went away. When the Carnivals stopped there
was a few years of nothing, then I think the Lions Club brought in a
Circus, this Circus came for 2 years if I remember right.
The problem with the cirus was not drinking or fights BUT the HIGH
Pressure tactic that were used to sell tickets. A few weeks before the
event, the circus would send in an advance ticket selling crew that
created many complaints from the town folk and merchants about the high
pressure used to sell the tickets. The Lions club ended up making very
little and received more negative than pro publicity for waht they were
trying to do. Thus they stopped sponsoring.
There are much easier and better ways for the Community Center to raise
money than a carnival or circus. If the car raffle is done right it
should be a winner. But you cannot sell 3000 tickets in 3 weeks to
anything.
The board of the center ought to talk to other groups in town that have
run sucessful fund raising events and see what and how they do it.

| The Maynard Planning board meeting is tonight at 7:30 p.m.. One of the
items on the agenda concerns the Maynard Motel site. Wendy's wants to
build a restaurant on the site. The problem is the site is zoned
industrial, which does not permit restaurants. The Maynard Motel site
is divided, with part of the site in Maynard and part in Acton.
The planning was approached about submitting a proposal to change the
zoning in the town to permit retail use in all industrial zones. At
the present time the Planning Board does not think it would be a good
idea to change all industrial zoning to allow retail use. Some of the
town official that I have talked think changing the zoning would be
a benefit to the town.
What do you think about it?

| I don't know much about this type of thing but I would be opposed to a "blanket"
change because of an isolated request. I would think that the best thing to do
would be to change the zoning for the property in question (IF people think that
this is in the best interest of the town) and then, as time permits, do a
complete study of the impact of an overall change.
While it might be a benefit to the town to allow retail use of ALL industrial
property, how much of a study has been done? I would rather see a complete
study done, even if it reached the same conclusion. It does not sound to me as
if there is any rush to make such a change.
Is this the first request of retail use of industrial property?
I would guess this is not quite the same thing but aren't Digital sites in town
zoned "industrial"? Most if not all of the sites have cafeterias that sell
food. What is the difference between an industrial building with a cafeteria
and a restaurant on industrial property?
How is the Acton portion of the land zoned? What is Acton's reaction to the
request by Wendy's?
Just some thoughts...

| The Planning Board met with the Wendy's people last night. The plans
call for a restaurant on the Maynard side and the parking lot on the
Acton side. The building and set up would be just like the Wendy's in
Marlboro on rt 20, except for some landscaping changes. The Planning
will meet with the Selectmen in the next couple of weeks to discuss
Maynard's options concerning the zoning.
The Acton portion of this site is zoned commercial, so Wendy's should
not have much problem with meeting Acton requirements. The 3 main
reasons Wendy's wants the restaurant on Maynard's are:
1. Maynard has town sewerage.
2. Maynard allows drive up windows, Acton does not.
3. Maynard does not have any sign rules, Acton does.

Acton's sign by-law is strict and I do not believe their sign would be

| I have a really strong opinion on signs, I think we should take a very
serious look at what they want to do. It's not like this is on the
side of some major highway that they need miles of visibility. If
you're on 62, you're going to see the Wendy's.
Is it higher than the Mc Donald's sign?
Is it bigger than the Mc Donald's sign?
If so, I think it's too big and too high. As it is, I think that
inflatable lobster (or whatever) thing they put up on top of the
McDonalds roof is unsightly (ok, so that's not a sign, but still).
Look at the towns with signage ordinances on their downtown stores,
then look at ours. Optimum would be that we had some sort of
consistency. Barring that, I think the minimum is that we keep
tight control over the lighted signs that are going to stick up in mid
air (actually, I don't think they shoud stick up in mid air).
This isn't Rt 9 yet, but it could easily start to feel that way with
one wayward sign. Please don't let this happen. They can have
their driveup, they can have a sewage tie, but get a concession on
the sign (what does the town need to do to control this?).

| A sign by law needs to be approved at a town meeting. Several years
ago a very complicated sign by law was soundly defeated at a town
meeting. If there is enough backing from the voters another less
complicated and less strict sign by law can be prepared for a future
town meeting.
The town can only enforce approved regulation, but we can ask for some
limitations.

I was just saying that in this instance, they want a zoning change.
That has got to give us a leverage for reasonableness on the sign
issue. There are precedences of planning board approval on proposals
"given that xyz is done". That gives us more to work with than
just asking nicely.
I drove by the McDonalds sign, it appears smaller than 10'wide and
less than 10' high for the lighted part. I can't judge overall
height. What height does Wendy's want?

| Last night the ZBA voted 4 to 1 in favor of granting Wendy's a
contiuation of the non-conforming use variance at the site of the
Maynard Motel.
Thew Planning board will continue the public hearing for site plan
approval for this project on 10-26-93. Wendy's must also proceed with
site plan approval in the Town of Acton.
The public hearing was not well attended. There were 2 people who
spoke in favor of Wendy's and 4 people who spoke againest the project.
There were about 14 people in attendance including the Wendy's
representatives and lawyer.

| At last nights meeting the Maynard Planning voted to approve the
site plan for Wendy's, which will be located at the Maynard Motel site.
The plan was revised several times over the last 6 months. Some of the
major changes Wendy's had to make were, moving the Drive 70 feet east
to allow more distance between the DEC driveway and a much smaller
sign.
Wendy's has some issues to work out with the Acton selectmen. Once
they resolve these, then Wendy's will start construction. The target date
for starting is this spring.
