    At the weekend, some careless individual drove into the back of my
    wife's car at a roundabout, pretty minimal damage to car, but fairly
    painful neck injury ensued (doc reckons whiplash).  Neither of us have
    had an accident before, and her car only has TPF&T insurance.  How do
    go about claiming for her injury ?  Should we use a solicitor, any
    recommendations in Reading area ?  Is it worth the aggro !!!

    are you in the AA/RAC? They often help out with such cases (or DAS, if
    you have cover from them for uninsured losses).

    If your insurance co. won't help and you have no cover for legal assistance
    I think your best bet is to go to the CAB and ask their advice. They
    should be able to offer you a free consultation 
    with a solicitor.
    
    I would say you have solid grounds for a claim if it was the other
    person's fault.

    On the local radio recently, and in the local papers, adverts have been
    appearing, saying "Have you had an accident recently, that wasn't your
    fault?. If so, we can follow up a claim for you". I think the adverts
    also said that it was on a 'no success, no pay' basis. The solicitors
    were Shoesmith & Harrison, who are pretty well known locally. I suppose
    they are after the increasing US-type litigation work. You might want
    to give them a call.

    Get a solicitor.  You're nobody when it comes to claiming as an
    individual against a huge organisation like an insurance company.
    
    I'm still waiting for compensation from June 7th last year when some
    idiot decided to drive head-on into me (cut and dry case - he was
    successfully prosecuted for driving without due care and attention). 
    Going rate for whiplash injuries seems to be about a piffling �1500 
    (that's what I've just been offered).  
    
    In this case, all the work has been carried out by soliciters appointed by 
    my insurance company specifically to recover uninsured losses; excess, 
    personal injury, loss of earnings etc. This claims service cost an extra 
    �12.00 per annum, well worth it when you see the amount of correspondance
    needed in such a case. Most companies offer similar services for TPF&T 
    insurance worth remembering next renewal.
    
    So as you can see, even with a solicitor doing the work it can take an
    age.
    
    In your case I assume that any claim against the other party would
    automatically include costs.  Talk to a solicitor and see how they
    would normally play such a case i.e do they want money up front or are
    they prepared to chance it?  This looks cut and dry to me and I would
    have thought that most solicitors would jump at the chance.

There is a note like this one earlier... my wife had a similar accident, when we 
took her car for repair, there was a leaflet from a company who specialise in 
'winning your claim'

We called them and within 24 hrs, my wife had a hire car, a specialists 
appointment and a solicitor.

Within 4 weeks, the opposing insurance company had settled out of court for the 
damage to the car, whiplash injury (�1000) and full costs.

Our outlay? Not a bean!

If its' definitely not your fault pursue it through one of these motor accident 
specialists, it paid for us.

    I would think �1000 is very low for a whiplash injury.
    
    
    I have had ongoing neck problems since Xmas (not caused by whiplash)
    and the physio is costing �18 a session... presumably whiplash can
    cause recurrent problems.
    
    As well as chasing for compensation I would suggest seeing a specialist
    asap as I think the sooner injuries are treated the more likely the
    chances of a complete recovery.

    My mother was invoved in a similar accident 6 or 7 years ago....12
    months later 4K + settlement. Take it all the way!!

    My wife was in an accident where a car ran into the back of hers
    whilst stopped in a line at a pelican crossing. DAS are funding the
    solicitor. The hire car costs were settled with a year, but the
    personal injury claim is still going on 4 years later.

Ah but my wife had kind of recovered in the 3 weeks it took to see the
specialist..... we could have pushed it further, you know, sex life
down the tubes, can't sleep at night all that stuff. But then we're honest!

    	Apparently, the "benefits" of a whiplash injury can appear in one's
    50's and 60's, I'm told.  I've heard of people having terrible pains in
    the neck region and others, many years later, the cause being related
    to a whiplash injury 20, 30 or even 40 years earlier.
    
    	�1000 - �4000 compensation now seems a piffling sum!  I would
    ensure that I go to see a specialist immediately, before settling any
    claims in this area - being honest or otherwise.
